Local Pickup – Truck Weight Capacity Disclaimer

    1. Customer Responsibility:
    o Customers are solely responsible for ensuring their vehicle does not exceed its manufacturer-recommended carrying capacity.
    o The operator assumes full accountability for any damages, mishaps, or issues arising from overloading or improper use of the vehicle.
    2. Release of Liability:
    o Vehicle Damage: Hudson Valley Biomass, Thinking Green, Inc. ™ and affiliates are not liable for any vehicle damage resulting from overloading or improper loading.
    o Operational Issues: The company is not responsible for any operational issues, such as tire wear, mechanical failures, or accidents caused by the load, including incidents where tonnage shifts, spills, or falls from the truck bed during transport. Responsibility for damages or claims resulting from such incidents falls solely on the vehicle operator and/or their insurer.
    o Legal Compliance: It is the customer’s responsibility to comply with all applicable weight and transportation regulations.
    3. Acknowledgment:
    o By signing or checking the box when ordering, you otherwise agree to these terms; customers accept all associated risks and release Hudson Valley Biomass, Thinking Green, Inc. ™, and its affiliates from any liabilities related to transporting wood pellets.

    Pickup Policy for Wood Pellets

    1. Safety Guidelines:
    o Customers must adhere to posted safety guidelines while on the premises.
    o Hudson Valley Biomass, Thinking Green, Inc. ™ and its affiliates are not liable for injuries, accidents, or other incidents on their property.

    Acknowledgment & Compliance

    • By participating in the pickup process, customers confirm their understanding and agreement to these terms, accept all associated risks, and commit to compliance with safety and transportation regulations.

    By placing an order for wood pellet delivery this will confirm OWNER’s acceptance of the terms and conditions set out below:

    OWNER acknowledges that it has the necessary authority and right to grant Hudson Valley Biomass, Thinking Green™, or its agent the right, privilege, and authority to access the referenced property address to deliver wood pellets (“Wood Pellet Delivery”).

    OWNER acknowledges that Hudson Valley Biomass, Thinking Green™, or its agent shall not be liable for any damages or losses to OWNER’S property located at the aforementioned property address. This is if damage or losses may occur due to wood pellet delivery. However,

    OWNER acknowledges that Hudson Valley Biomass, Thinking Green™ and its agents are not responsible for any indirect, incidental, special, or consequential damages arising from or related to wood pellet delivery.

    OWNER acknowledges that Hudson Valley Biomass, Thinking Green™ and its agents may use reasonable measures to prevent any damages to the property. However, they cannot guarantee their complete avoidance. OWNER agrees to indemnify and hold Hudson Valley Biomass, Thinking Green™, and its agents harmless from and against
    any claims, damages, or losses arising from or related to the wood pellet delivery.

    OWNER acknowledges that Hudson Valley Biomass, Thinking Green™ and its agents have the right to terminate or cease wood pellet delivery at any time and without notice.

    OWNER acknowledges that the terms and conditions mentioned above supersede any previous agreements or understandings between OWNER and Hudson Valley Biomass, Thinking Green™, or its agent. This is regarding wood pellet delivery.

    OWNER acknowledges that it has read and understood the terms and conditions set out above. It agrees to be bound by them to the fullest extent allowed by law. Placing an order for wood pellet delivery will signify you fully comply with the above-stated terms and conditions. You will also exercise the purchasing of the order as your signature.
